本文係以網路服務提供者商標權間接侵害責任為探討,有別於傳統商標權直接侵害之常見侵害類型,商標權間接侵害特別於網際網路發達之今日更有討論之實益,惟由於主張商標權間接侵害者昔日不多見,不論我國法或外國法仍屬發展中之責任類型,故本文以外國法之發展歷程觀察比較,作為我國未來發展之理論與立法之基礎。首先以網路服務提供者之概念介紹,將網路服務提供者定義,接著就網路服務提供者之類型為闡述,由於網路服務提供者之種類多樣,其得依功能性區分或法律區分類型,而後再就網路服務提供者之定位為界定。再者為美國法商標權侵害理論之介紹,以美國法相關規範為主軸,美國聯邦商標法就直接侵害行為有明文清楚規範,惟其對間接侵害理論並

無明文規範,而係美國法院從普通侵權行為法透過判決發展而來,其中關於輔助侵最重要者即為Inwood Laboratories v. 主,在歐盟法院有明確規範依循之情形下,因而產生不同之差異。本文試圖從我國不同法規範之解釋尋找網路服務提供者商標權間接侵害責任適用之可能,其中商標法為特別法最先介紹,以商標權侵害之規定與要件說明,而後再討論民法、刑法、公平交易法適用上之疑義。我國目前之實務判決雖非直接與網路服務提供者之商標權間接侵害責任相關,惟仍得藉由相關判決探知法院對於網路服務提供者相關法律責任之心證,如我國是否須對此爭議問題明文規範,而其規範方式及內容應為何,有相當參考之價值。最後,比較現行法之缺失,提供本文對商標權間接侵害責任之規範建議。
