在裁決制度運行已近十年之際，不當勞動行為態樣及案例已發展越趨完整，無論是申請人或相對人於裁決上主張與答辯皆越發細膩，對於我國法制完整化提供莫大助益，然也造成一些邊緣案例認定困難之情形。本文重心即研究雇主對於工會會員及工會行動以間接歧視之方式進行不當勞動行為，擬聚焦探討間接歧視於不當勞動行為裁決制度之應用可能，蓋若要完全避免集體勞動基本權為無當之限縮或限制，即要保護工會會員在從事工會行動時能夠完全享有與非工會會員同樣之平等保障，免於受到差別待遇或差別影響。是而，本文將由間接歧視理論、認定標準、舉證責任出發，再與我國不當勞動行為制度作輝映與比較，探求各該法規之成立要件、舉證模式與救濟結果，嘗試將

間接歧視之概念套用於現有不當勞動行為要件中，並探討依照現行法解釋論可能遇到之困難。而因我國法制暨實務並未意識到此一問題因而仍未有解決，當尋求美國法實務及學說見解作為比較參考對象。本文欲透過整理與回顧我國裁決、法院相關實務見解釐清現行法問題所在，並從比較法之觀點，檢視美國法之差別影響歧視理論是否能夠運用至我國裁決案例之中，期以此為借鏡，試圖釐清差別影響歧視之認定模式及舉證責任方式，探查勞動關係中間接歧視背後之結構性問題，以促進我國集體勞動基本權之充分保障。
