由於台灣最大最繁忙的商業港口高雄港(KHH)的工業活動增加,導致大氣中揮發性有機化合物(VOCs)的排放量也急劇增加。由於揮發性有機化合物對人體健康的影響以及造成臭氧(O3)和次要有機氣溶膠(SOAs)的形成,引起了大眾對環境的關注。因此,本研究目的中確定 KHH 中存在 VOCs,此外我們旨在了解 VOC 的時空變化和來源分配及其在研究區形成二次污染物的潛力。為了實現這些目標,在港口和加工出口區(KEPZ)的第一和第二個入口(E1和E2)進行了四次採樣(2月、5月、7月和11月)。3個採樣點TVOCs平均濃度均以11月最高(37.7±12.6 ppbv)。以平均TVOC濃度為基礎的VOCs

空間分佈顯示,污染等級為KEPZ > E2 > E1。2020年,在KHH中,c2化合物是TVOCs的最大貢獻者(41.1%),其次是芳[香]烴(19.3%)。其中,甲苯和丙酮是各點TVOCs的主要貢獻者。計算的臭氧生成潛勢(OFP)與總VOCs濃度呈顯著正相關。同時,二次有機氣溶膠生成潛勢(SOAFP)主要受甲苯濃度的影響。結果顯示,VOCs主要來自當地氣團。利用正矩陣分解因子(PMF)模型對VOCs的潛在來源進行量化。確定了3種可能的VOCs來源:工業排放(53.63%)、貨運排放(29.63%)和其他(17.74%)。本研究旨在了解胡志明市VOCs的現狀及來源。本研究結果可有效改善港口工

營業祕密損害賠償計算之研究

營業祕密損害賠償數額該如何認定,為目前實務及原被告訴訟中所遇到之難題。原因在於,營業祕密具有祕密性,少有參考之市場價值,且其價值通常非單獨存在,需經利用、投入等生產行為才能產生價值;此外若未運用該營業祕密,是否產生損害亦難以估計,加上我國目前實務案件量不多,也難以從案件中建立清楚的體系及計算方式,學說上亦少有研究。但在營業祕密越發重視的今日,營業祕密損害賠償數額將會是營業祕密訴訟上的攻防重點,為實務上不得不面對的問題。  本研究欲藉由美國營業祕密的法律規定及實務判決之研析,去探討我國營業祕密的法規及實務計算上該如何參考及使用。本研究建議我國營業祕密法第13條不需要刪除擇一請求,但可引入合理權

利金,以減少原告舉證責任;實務上則建議將損害填補中所失利益和侵權所得利益採不同的計算方式,以釐清兩者之關係,並適時將合理權利金放入法院酌定情形中作判斷,而本研究所列出美國實務判決的參考因素,亦可適用於我國損害賠償的各項計算中,使得原被告能依各項因素舉證攻防,法院加以參考作計算,讓營業祕密損害賠償不再落入難以計算,不知道該如何舉證之困境。
