本文於第一章指出職場上性別平等並不僅是社會正義的議題,對於企業來說亦是建立穩健企業體制之一大關鍵。再來,本文發現許多人認為在同性婚姻通過後,我國早已是性別平等的國度,然而事實上,在近年的調查之中,仍能發現職場中性別不平等甚至是性別暴力的事情仍存在,其中身為性少數中的性少數群體的跨性別者尤為嚴重,故本文想藉由此篇論文,探究法律要如何突破,並建立出跨性別友善的就業環境。第二章的部分,首先點出跨性別者早已存在於社會中的事實,並進一步解釋並定義本文中所使用到多元性別觀點內各名詞之意義為何,最後透過簡單例舉的方式,勾勒出跨性別者於職場上受憲法保護的權利為何,進一步的為後面談到抽象的平等權奠定基礎。第三

章開始,將以平等原則做為中心,介紹就業歧視禁止之相關法律。首先介紹美國的民權法,從其歷史脈絡開始,接著定義出民權法所適用之主、客體為何,緊接著介紹民權法施行60餘年來由美國判決先例而創建之反歧視法之體系,及其中所規範的歧視種類。了解歧視如何成立的同時,也需知道雇主要如何說理,才能建立雇主與受僱者間的法律上平等關係。在理解了法律之基礎要件後,本文將進一步探究美國法院實務對跨性別者就業相關之判決發展為何。於第四章,本文將焦點回至我國,本文將先探究在憲法上,跨性別者是否為憲法平等原則所保障之客體。此外,亦會探究憲法第7條及增修條文第10條第6項,國家為落實實質平等,國家有為積極平權措施之義務之依據及

違憲審查基準,並於後探究積極平權措施之界限。第五章則是以性別工作平等法為討論中心,探究與跨性別者就業平等相關的法律規範適用方法與定義,並深究近年來我國實務對跨性別者就業歧視之態度與審查基準為何,並佐以美國民權法與我國憲法之觀點為評析。在最後之第六章,本文將綜合三至五章之觀點,提出對於現在行政、司法、立法之規定與制度改進之建議,並為結論。

台灣空軍現有的141架F-16 戰機,在美方政府的支持及洛克希德·馬丁公司技術協助之下,開啟了「鳳展專案」台灣與美方也進一步進行合作交流,本研究將以次級資料分析「鳳展專案」,將我國在國家安全上所面臨的威脅、現今國際情勢的險峻、我國國防對美國的需求、軍購武器獲得的窘境、國防自主政策的發展過程進行文獻分析;並以執行中購買之新式66架F-16V採購案,探討我國啟動F-16維修中心國防自主政策如何落實與推動,再以 SWOT 歸納分析法針對「鳳展專案」政策的強點、弱點、機會與威脅進行分析。本研究發現:F-16 A/B升級計畫對於國防自主政策,具有促進我國航太產業發展、研發下一代戰機的戰略意義,並可達成

政治、經濟、心理、軍事等四大國家戰略目標,來確保國家安全。
